Contest Rules
This contest (the “Contest”) to win 1 of 3 iPod touch 32GB units, is organized by the New Brunswick Dental Society (the “Sponsor”). The Contest begins Thursday April 1, 2010 (the “Contest Start Date”) and terminates on Friday May 7, 2010 (the “Contest Close Date”).
HOW TO ENTER
The entry form (the “Entry Form”) to participate in the Contest is available on the Internet at www.NBDental.com.
No purchase necessary.
To enter the Contest, the participant (the “Participant”) must complete the online Entry Form with his/her name, address, age and daytime phone number.
Entry Forms received after the Contest Close Date are not eligible to participate in the Contest and will not be accepted by the Sponsor.
PRIZE
The prize to be won is an iPod touch hereinafter referred to as the “Prize”.
SELECTION OF THE PRIZE WINNERS
A random draw from all eligible Entry Forms received will take place on Friday May 14 th, 2010 (the “Draw Date”) at 12:00 p.m. local time, at 38 Sydney Street in Saint John, New Brunswick. Chances of winning the Prize are dependent upon the total number of eligible Entry Forms received. The selected Participant will be notified by telephone within fourteen (14) days of the Draw Date. In the event that the selected Participant cannot be contacted by telephone after three (3) attempts within fourteen (14) days of the Draw Date, the Sponsor reserves the right to disqualify the selected Participant and to randomly select another Participant from among all of the remaining Entry Forms received.
ELIGIBILITY AND GENERAL CONDITIONS
The Contest is only open to persons who are the age of majority and resident in the province of New Brunswick, as of the Contest Start Date, excluding employees, representatives and agents of the Sponsor and its affiliates, their advertising and promotional agencies, the independent judging organization and all those with whom they are domiciled cannot participate in the Contest. By participating in the Contest, Participants agree to abide by these Contest rules and decisions of the Contest judging organization, which shall be final. The Contest is subject to all applicable federal, provincial and municipal laws and regulations. Subject to any required government consent, the Sponsor reserves the right to cancel or suspend the Contest in the event of any accident, or administrative or other error of any kind.
Participants must have completed the Entry Form in full, including having correctly answered the mathematical skill-testing question that appears on the Entry Form. Entry Forms must be received no later than on the Contest Close Date and be received by the judging organization prior to the Draw Date. The selected Participant will be required to sign a declaration and release form that will release the Sponsor from all direct and indirect liability regarding the Contest and the Prize.
Only one entry per day per email address.
All Entry Forms become the sole property of the Sponsor and will not be returned to the Participants. The Sponsor will not be responsible for Entry Forms that are received late for any reason, illegible in whole or in part, incomplete, erroneous, lost or misdirected. In any case, the Sponsor and its agents cannot be responsible for a value of more than three hundred dollars in Canadian currency ($CDN $300.00) for the Prize. In order to receive the Prize, the selected Participant must sign a document consenting to the use of his/her name, address and photograph for publicity purposes, without further compensation, and releasing and indemnifying the Sponsor, its associated companies, advertising and promotional agencies, distribution companies, Prize suppliers, employees and respective agents from any liability whatsoever occurring as a result of the participation in the Contest or of a Prize being awarded or used. Correspondence will only be exchanged with the selected Participants. Please allow between four to six (4-6) weeks for the reception of the Prize from the date on which the Sponsor has received the signed declaration and release form from the selected Participant. The refusal to accept a Prize releases and forever discharges the Sponsor and its agents of all obligations related to the Contest, including the award of the Prize and its delivery.
The Prize is not transferable, must be accepted as awarded and is not convertible to other property, in whole or in part, at the request of the winner. However, the Sponsor reserves the right to substitute all or part of the Prize with an item or items that are similar to and of equivalent value with any item forming part of the Prize, without prior notification to the winner, at the Sponsor’s sole and entire discretion.
The Sponsor and its agents are not responsible for printing, distribution or production errors and, subject to any required government consent, the Sponsor may, in its sole discretion, terminate the Contest at any time, without any liability whatsoever.
The Sponsor is not responsible for any disruption or failure of any Internet service providers or web hosting providers which results in late delivery of any Entry Form.
The Sponsor may, subject to any required government consent, at its sole discretion, cancel or suspend the Contest should any cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately undermine the legitimate progress of the Contest is a violation of criminal and civil laws, and should such attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Entry Forms are subject to verification and will be declared invalid if they are illegible, forged, falsified, altered or tampered with in any way.
